Megan’s department is in charge of refurbishing a restaurant in the Clubhouse. She is the project coordinator.  

Gavin

Hi Megan, you are in charge of a Clubhouse refurbishment project. You need to engage consultants for design and decoration, and find suppliers for the furniture.

Narrator

Megan has a friend, Bob, who is a well-known decorator.  She heard that there is a Single Quote process so she is thinking to ask Bob to give a single quotation for the decoration work, instead of inviting tenders. 

Narrator

This project has a tight schedule.  It will save time if I invite single quotation instead of going through the tendering process.

As I have other projects in hand, it will be convenient and less work for me if I simply ask Bob to help.

Bob is well-known in the industry. Going through single quote can ensure that he will be in charge of the work which is good for the Club too.

Do you think it is appropriate for Megan to use Single Quote process to find a consultant?

Gavin

No, Megan, it is not appropriate to use Single Quote just because it is more convenient or you are busy.

Gavin

Engagement of vendors and procurement are governed by the Club’s Procurement Policy.

Tender and request for proposals from competitive vendors are required in procurement.

Gavin

Single Quote is allowed only in exceptional circumstances. For example, the supplier is the sole and only one available source in the market, or the source is the single source for an integrated system. Single Quote application must be supported by sufficient justification and approved by designated senior management in accordance with the Procurement Policy.

Gavin

If Single Quote is permitted in exceptional circumstances, other procurement procedures shall still be followed, including request for proposals, contract negotiation and designated approval.

Megan

Thanks Gavin. Since there are other qualified decorators in the industry, I will invite competitive bidding to select the most suitable consultant then.

For refurbishing the restaurant in the Clubhouse, Megan also needs to procure a large quantity of dining chairs with high quality and within the budget.

Megan remembers her friend Toby is a furniture manufacturer with good track record. She is thinking of inviting him to tender for the project.

Do you think Megan should invite her friend Toby to tender for the supply of dining chairs? Please select the most appropriate advice for Megan.

Employees are permitted to invite suitable vendors to be registered as suppliers to bid for the Club’s contracts. Employees must declare their relationship and any potential conflict of interest with the vendors during the procurement process.

Conflict of Interest: You should always avoid and declare any real or perceived conflict of interest.

Competition: Competitive tenders should be invited to bid for the contract in an open and fair environment.

Competitiveness: Award should be based on merits and price competitiveness, not personal interest.

Confidentiality: Maintain confidentiality in the tender process. Do not disclose commercially sensitive information to favor any bidder.

Hello, I’m Kyle from  Woodwork Furniture. We are planning to tender for the supply of dining chairs. Can we make a deal?

Megan

How can I help you?

Kyle

Our company can offer you a 3% rebate if you help us to get the contract.

Megan

I’m not sure about that.

Kyle

I understand that you are new to the Club and might not be senior enough to make the decision.  How about asking Gavin for his approval? Maybe we can make a deal together?

Narrator

What would you do if you were Megan?

If Gavin approves the acceptance, is it permissible for Megan to accept the rebate?

Narrator

Employees are not allowed to solicit, offer or accept bribe in the conduct of the Club’s business.

Remember the higher duty expected on public servants.

It is an offence to offer advantage to the Club’s employees or to accept such advantage in order to influence the Club’s decision on the award of contracts.

There is no defence that the suggestion is approved by your supervisor. In fact, the supervisor might also be criminally liable if he/she has knowledge of or agrees to the acceptance of such advantage.

If Megan rejects the offer, are there any other follow-up actions she should take?

Megan has rejected Kyle’s offer and reported the incident to Gavin.
